    These Terms of Service ("Terms") govern your use of the Gallerina platform operated by QUIETCODE (PRIVATE) LIMITED ("Company," "we," "us," or "our"), including our website at https://gallerina.app and all related services (collectively, the "Service").

    By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

    ACCEPTANCE OF TERMS

    By creating an account, accessing, or using the Gallerina platform, you confirm that you:

    • Are at least 18 years of age and have the full legal capacity to enter into these Terms
    • Have the legal capacity to enter into these Terms
    • Will comply with all applicable laws and regulations
    • Agree to be bound by these Terms and our Privacy Policy

    DESCRIPTION OF SERVICE

    Gallerina is a photography platform that allows photographers to showcase their work, manage client projects, and facilitate photo sharing and delivery. The Service includes but is not limited to:

    • Photo hosting and gallery creation
    • Client proofing and selection tools
    • Project management features
    • Photo delivery and download capabilities
    • User profiles and portfolio displays

    USER RELATIONSHIPS AND DISPUTES

    • Gallerina as a Venue. Our Service acts as a venue to allow users who comply with our policies to connect with and enter into agreements with other users (e.g., photographers and their clients). You acknowledge that Gallerina is not a party to any agreement, contract, or transaction between users. We do not hire or employ photographers, nor do we act as an agent for any user.
    • User Responsibility and Disputes. We are not responsible for the conduct, whether online or offline, of any user of the Service. We are not responsible for the quality of the work provided by photographers or the fulfillment of any agreement between users. You are solely responsible for your interactions and agreements with other users.
    • Release. In the event that you have a dispute with one or more other users, you agree to release QUIETCODE (PRIVATE) LIMITED (and our officers, directors, agents, and employees) from all claims, demands, and damages of every kind, known and unknown, arising out of or in any way connected with such disputes.

    USER ACCOUNTS

    You are responsible for:

    • Maintaining the confidentiality of your account credentials
    • All activities that occur under your account
    • Notifying us immediately of any unauthorized use
    • Providing accurate and complete registration information

    We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

    USER CONTENT AND INTELLECTUAL PROPERTY

    You retain ownership of all content you upload to the Service. However, by uploading content, you grant us a limited license to:

    • Store, display, and deliver your content through the Service
    • Create thumbnails and optimize images for platform functionality
    • Backup and maintain your content for service reliability

    You represent and warrant that:

    • You own or have proper rights to all uploaded content
    • Your content does not infringe on third-party rights
    • You have obtained necessary model releases and permissions
    • Your content complies with all applicable laws

    PROHIBITED ACTIVITIES

    You agree not to engage in any of the following prohibited activities:

    Content Violations

    • Upload copyrighted images without proper authorization
    • Post inappropriate, offensive, or explicit content
    • Share content that violates privacy rights or lacks proper model releases
    • Distribute content that promotes violence, hate speech, or discrimination

    Platform Misuse

    • Create fake accounts or impersonate others
    • Use automated tools, bots, or scripts without authorization
    • Attempt to hack, compromise, or breach platform security
    • Overload servers through excessive requests or spam

    Privacy & Safety Violations

    • Share personal information of others without consent
    • Engage in stalking, harassment, or threatening behavior
    • Publish private communications without permission
    • Collect user data for unauthorized purposes

    Commercial Violations

    • Sell or redistribute user content without permission
    • Engage in price manipulation or fraudulent billing practices
    • Use the platform for unauthorized commercial activities
    • Circumvent payment systems or subscription requirements

    SUBSCRIPTION AND PAYMENTS

    Certain features of the Service require paid subscriptions. By subscribing, you agree to:

    • Pay all applicable fees as described in your subscription plan
    • Automatic renewal of subscriptions unless cancelled
    • Our right to change subscription fees with advance notice
    • All fees are non-refundable except as expressly stated in our Refund Policy or as required by applicable law. Please review our Refund Policy for detailed information on eligibility for a refund.

    All payments are processed securely through our payment partners. We do not store your payment information directly.

    PRIVACY AND DATA PROTECTION

    Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

    SERVICE AVAILABILITY

    We strive to maintain high service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

    • Scheduled maintenance and updates
    • Technical issues or server problems
    • Third-party service disruptions
    • Force majeure events

    LIMITATION OF LIABILITY

    To the fullest extent permitted by law:

    • Your use of the Service
    • Your violation of these Terms
    • Your content or activities on the platform
    • Your violation of any third-party rights

    TERMINATION

    We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:

    • Violates these Terms or our policies
    • Is harmful to other users or third parties
    • Violates applicable laws or regulations
    • Is otherwise objectionable

    Upon termination, your right to use the Service will cease immediately. We may delete your account and content, though we may retain certain information as required by law.

    DISPUTE RESOLUTION

    These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms or your use of the Service shall be resolved through:

    • Good faith negotiations between the parties
    • Binding arbitration if negotiations fail
    • Sri Lankan courts for matters that cannot be arbitrated

    CHANGES TO TERMS

    We reserve the right to modify these Terms at any time. We will notify users of significant changes by:

    • Posting the updated Terms on our website
    • Sending email notifications to registered users
    • Displaying notices within the Service

    Continued use of the Service after changes constitutes acceptance of the new Terms.

    SEVERABILITY

    If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
